Welcome to Novacore Digital ("Novacore Digital", "we", "our", or "us"). These Terms & Conditions govern your use of our website and the services we provide. By accessing our website or engaging our services, you agree to these Terms.

2. Services

Novacore Digital provides, but is not limited to:

• Website Design & Development
• E-commerce Website Development
• Graphic Design
• Logo & Brand Identity Design
• Social Media Design & Management
• Website Maintenance
• SEO & Digital Marketing Services
• Custom Digital Solutions

Each project is governed by an individual quotation or proposal accepted by the client.

3. Quotations

All quotations:

• Are valid for 30 days from the date issued.
• May change if the project scope changes.
• Do not include additional work unless specifically stated.

Any work requested outside the approved quotation will be quoted separately.

4. Payments

Unless otherwise agreed in writing:

• A 50% non-refundable deposit is required before work begins.
• The remaining balance is payable before the website or final artwork is released.
• Projects exceeding R20,000 may follow milestone payments.

Late payments may delay project delivery.

5. Refund Policy

Due to the custom nature of our services:

• Deposits are non-refundable once work has commenced.
• Completed design or development work is non-refundable.
• Refunds will only be considered where Novacore Digital is unable to deliver the agreed service.

6. Project Timelines

Estimated delivery times are provided as a guideline.

Project delays caused by the client (including delayed content, approvals, or payments) may result in revised delivery dates.

Novacore Digital is not liable for delays caused by third-party providers.

7. Client Responsibilities

The client agrees to:

• Provide accurate information.
• Supply all required text, images, logos, and content.
• Ensure they have permission to use all supplied materials.
• Review work promptly and provide feedback.

Failure to provide requested information may delay the project.

8. Revisions

Each package includes a specified number of revisions.

Additional revisions beyond those included may incur additional charges.

Requests that substantially alter the approved design or project scope will be treated as new work.

9. Website Content

Clients are responsible for ensuring that all content supplied:

• Does not infringe copyright.
• Is accurate.
• Complies with applicable laws.

Novacore Digital reserves the right to refuse content that is unlawful, offensive, defamatory, or infringes intellectual property rights.

10. Intellectual Property

All concepts, mock-ups, source files, and designs remain the property of Novacore Digital until full payment has been received.

Once payment has been made in full:

• The client owns the final approved design deliverables specified in the quotation.
• Novacore Digital retains the right to display completed work in its portfolio and marketing materials unless otherwise agreed in writing.

Third-party fonts, plugins, stock images, and software remain subject to their respective licence agreements.

11. Website Hosting & Domains

Unless specifically included:

• Hosting is billed separately.
• Domain registration is billed separately.
• Clients are responsible for annual renewal fees.

Failure to renew hosting or domain services may result in website downtime.

12. Website Maintenance

Websites not covered under a maintenance agreement are the client's responsibility after handover.

Maintenance packages are available on a monthly basis.

13. Third-Party Services

Some projects may include third-party services such as:

• Payment gateways
• Hosting providers
• Email services
• Google services
• Social media platforms

Novacore Digital is not responsible for outages, policy changes, pricing changes, or interruptions caused by third-party providers.

14. Limitation of Liability

To the maximum extent permitted by law, Novacore Digital shall not be liable for:

• Loss of profits
• Business interruption
• Data loss
• Website downtime caused by third parties
• Indirect or consequential damages

Our total liability shall not exceed the total amount paid by the client for the specific project.

15. Confidentiality

Both parties agree to keep confidential information private and not disclose it to third parties unless required by law.

16. Cancellation

Either party may cancel a project by providing written notice.

If work has already commenced:

• The deposit remains non-refundable.
• The client will be invoiced for work completed up to the cancellation date.

17. Portfolio Rights

Unless agreed otherwise in writing, Novacore Digital may display completed work on its website, portfolio, and social media for promotional purposes.

18. Privacy

Your personal information is processed in accordance with our Privacy Policy and applicable South African privacy legislation, including the Protection of Personal Information Act (POPIA).

19. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.

20. Changes to These Terms

Novacore Digital reserves the right to amend these Terms & Conditions at any time.

Updated versions will be published on our website with the revised effective date.
